    Sold about 76 seconds of stock a few weeks ago to a company making a promo for another company in Belize. Several of the shots were of divers swimming around whale sharks as well as striding off the boat. It all depends upon the production's needs. Shoot those divers anyway, you never know when it will come in handy. It was a nice paycheck, all too infrequent but nice to have-Steve B)

  3. I licensed some footage with divers in for a UK TV commercial and releases were not even mentioned. Which is lucky because I didn't have them.

    Some of the reading for the legal side of my situation of late may interest you can be found here

     

    Take a look at each and every case for strong case points in my favor. Production companies can use imagery of people taken in public places so long as they attest to the actual events. Once they stray from that, by using video special effects for example and overlaying a sound file to pervert the actuality of the event, then they are guilty of an invasion of privacy and defamation.

     

    1. Invasion of Privacy

    Every person has a right to be left alone --this is called the right of privacy. A release is needed to use a living person's name or image in a manner that constitutes an invasion of the person's right to privacy. Releases are vital because a person whose privacy is invaded can sue for monetary damages. Generally, invasion of privacy isn't an issue for individuals who are dead.

     

    Good reading and a valid point to take in when future filming of tourist divers etc.
